١١ - وفي ضوء ما تقدم، ترى اللجنة أن الدولة الطرف ملزمة، في الظروف الراهنة، بالامتناع عن إعادة السيد كافح ياراغ طالا بالقوة إلى إيران، أو إلى أي بلد آخر يواجه فيه خطرا حقيقيا بطرده أو إعادته إلى إيران.

٧ - وعلى ضوء ما سبـق، تــرى اللجنة أنه، نظرا للظروف السائدة، فإن الدولة الطرف ملزمة وفقا للمادة ٣ من الاتفاقية بالامتناع عن إعادة مقدم البلاغ قسريا إلى تونس أو إلى أي بلد آخر يواجه فيه خطرا حقيقيا بطرده أو إعادته إلى تونس.

7. In the light of the above, the Committee is of the view that the State party has an obligation, in conformity with article 3 of the Convention, to refrain from forcibly returning the author to Turkey or to any other country where he runs a real risk of being expelled or returned to Turkey.
٦-٧ وفي ضوء ما سلف، ترى اللجنة أن الدولة الطرف، بمقتضى المادة ٣ من الاتفاقية، ملزمة بالامتناع عن إعادة مقدم البلاغ قسرا إلى تركيا أو إلى أي بلد آخر يواجه فيه خطرا حقيقيا يتمثل في طرده أو إعادته إلى تركيا.

7. In the light of the above, the Committee is of the view that, in the prevailing circumstances, the State party has an obligation to refrain from forcibly returning Mr. Ali Falakaflaki to the Islamic Republic of Iran, or to any other country where he runs a real risk of being expelled or returned to Iran.
٧ - وفي ضوء ما تقدم، ترى اللجنة أن الدولة الطرف ملزمة، في الظروف الراهنة، بالامتناع عن إعادة السيد علي فلكفلاكي بالقوة إلى جمهورية إيران اﻹسلامية، أو إلى أي بلد آخر يواجه فيه خطرا حقيقيا بطرده أو إعادته إلى إيران.
