1. 1 - إذا لم تقم الدولة الطرف التي يوجد في إقليمها مرتكب الجريمة المفترض بتسليم ذلك الشخص، تكون ملزمة بإحالة القضية، دون إبطاء لا لزوم له وبدون أي استثناء وسواء كانت الجريمة قد ارتكبت أو لم ترتكب في إقليمها، إلى سلطاتها المختصة لغرض الملاحقة الجنائية حسب إجراءات تتفق مع قوانين تلك الدولة.

While the condition that such a submission be made " without exception whatsoever and whether or not the offence was committed in its territory " has been included in some conventions,
وفي حين أن شرط إحالة القضية " بدون أي استثناء وسواء كانت الجريمة قد ارتكبت أو لم ترتكب في إقليمها " قد أُدرج في بعض الاتفاقيات()،

١ - على الدولة المتعاقدة التي يكون المدعى ارتكابه الجريمة موجودا في إقليمها، في حالة عدم تسليمها إياه، أن تعمد دون أي استثناء كان، وسواء ارتكبت الجريمة أو لم ترتكب في إقليمها، الى عرض القضية على سلطاتها المختصة بقصد المحاكمة، عن طريق دعوى ترفع وفقا لقوانين تلك الدولة.

١ - تكون الدولة الطرف التي يوجد في أراضيها المجرم أو الشخص المنسوبة إليه الجريمة ملزمة، بدون استثناء أيا كان وسواء ارتكبت الجريمة أو لم ترتكب في أراضيها، أن تحيل القضية دون إبطاء إلى سلطاتها المختصة بقصد المحاكمة من خلال إجراءات تتفق وقوانين تلك الدولة وذلك ما لم تكن قد سلمت ذلك الشخص.
