1. States parties shall, in accordance with human rights standards, declare illegal and prohibit all organizations based on ideas or theories of superiority of one race or group of persons of one colour or ethnic origin, or which attempt to justify or promote national, racial and religious hatred and discrimination in any form.

In this context, it should be noted that article 4 of the International Convention on the Elimination of All Forms of Racial Discrimination obliges States Parties to condemn all propaganda and any organizations that are based on ideas or theories of the superiority of one race or group of persons of one colour or ethnic origin, or which attempt to justify or promote racial hatred and discrimination in any form.

Under the terms of this article, States parties undertake to prevent, prohibit and condemn all propaganda and all organizations which are based on ideas or theories of superiority of one race or group of persons of one colour or ethnic origin or which attempt to justify or promote racial hatred and discrimination in any form, and also undertake to declare illegal, and punish, such propaganda or organizations.

ICERD does not contain specific clauses referring to genocide but emphasizes that States parties are to " condemn all propaganda and all organizations which are based on ideas or theories of superiority of one race or group of persons of one colour or ethnic origin, or which attempt to justify or promote racial hatred and discrimination in any form... " .
