وبالإشارة إلى الفقرة 37 من تقرير الدولة الطرف، يرجى تقديم معلومات عن التمتع بالحقوق الدستورية بالنسبة للعمال المهاجرين وأفراد أسرهم الذين ليست لديهم الوثائق اللازمة.

26. As regards migrant workers " who are undocumented " , in the words of the question, a distinction is drawn between the following two cases:

The Working Group on Arbitrary Detention has devoted particular attention to the situation of detained migrants, including migrants who are undocumented or in an irregular situation, asylum seekers awaiting the outcome of their asylum application and failed asylum seekers awaiting removal (Working Group opinions 55/2011 and 14/2011).
39- وقد كرس الفريق العامل المعني بالاحتجاز التعسفي اهتمامه بوجه خاص لحالة المهاجرين المحتجزين، بمن فيهم المهاجرون الذين لا يحملون وثائق هوية أو من هم في وضع غير نظامي، وملتمسو اللجوء الذين ينتظرون نتائج طلباتهم، وملتمسو اللجوء الذين رُفضت طلباتهم وينتظر ترحيلهم (رأيا الفريق العامل 55/2011 و14/2011).

وإذ تضع في اعتبارها حالة الضعف التي كثيراً ما يجد المهاجرون أنفسهم فيها لأسباب عديدة من بينها غيابهم عن دولهم الأصلية، والصعوبات التي يواجهونها بسبب الاختلافات في اللغة والعادات والثقافة، وكذلك الصعوبات الاقتصادية والاجتماعية والعراقيل التي تعترض عودة المهاجرين إلى دولهم الأصلية، خاصة الذين ليست لديهم الوثائق اللازمة أو الذين هم في وضع غير قانوني،
