1. The State Party in the territory under whose jurisdiction a person alleged to have committed an offence of enforced disappearance is found shall, if it does not extradite that person or transfer him or her in accordance with its international obligations to another State or transfer him or her to an international criminal tribunal whose jurisdiction it has recognized, submit the case to its competent authorities for the purpose of prosecution.

They refer to the report of an expert of the Working Group on Enforced or Involuntary Disappearances, in which he states that the primary responsibility for carrying out those tasks remains with the authorities under whose jurisdiction a suspected mass grave falls (E/CN.4/1996/36, para. 78).

2. The State Party within whose jurisdiction a mission is to take place or is being carried out shall provide the mission with all the facilities necessary for the proper fulfilment of its tasks and promote the full cooperation of all competent authorities.
٢- على الدولة الطرف التي يعتزم إيفاد بعثة في إطار ولايتها القضائية أو التي يجري بالفعل تنفيذ بعثة فيها أن تقدم للبعثة جميع التسهيلات اللازمة ﻷداء مهمتها على نحو ملائم وأن تعزز التعاون الكامل من جانب جميع السلطات المختصة.

If the judge declares the detention to be illegal (or the charges unfounded) the person concerned must immediately be released by the authority under whose jurisdiction he is being detained.
فإذا أعلن القاضي أن الاحتجاز غير مشروع (أو أن التهم غير صحيحة) وجب على السلطة التي احتُجز الشخص المعني في إطار ولايتها القضائية أن تفرج عنه فوراً.

٢- على الدولة الطرف التي يعتزم ايفاد بعثة في إطار ولايتها القضائية أو التي يجري بالفعل تنفيذ بعثة فيها أن تقدم للوفد جميع التسهيلات اللازمة ﻷدائه لمهمته على نحو ملائم وأن تعزز التعاون الكامل من جانب جميع السلطات المختصة.

The deletion of the words " whose jurisdiction it has recognized " was also proposed.
كما اقتُرح حذف عبارة " تعترف باختصاصها " .

2. Each State Party shall likewise take such measures as may be necessary to establish its jurisdiction over the offence of enforced disappearance when the alleged offender is present in any territory under its jurisdiction, unless it extradites or transfers him or her to another State in accordance with its international obligations or transfers him or her to an international criminal tribunal whose jurisdiction it has recognized.
2- تتخذ كل دولة طرف كذلك التدابير اللازمة لإقرار اختصاصها بالبت في جريمة اختفاء قسري عندما يكون مرتكب الجريمة المفترض متواجداً في أي إقليم يخضع لولايتها القضائية، ما لم تسلمه أو تحله إلى دولة أخرى طبقاً لالتزاماتها الدولية، أو ما لم تحله إلى محكمة جنائية دولية تعترف باختصاصها.

In other words, police forces whose jurisdiction covers only part of the country, such as provincial police or state police.
