On the other hand, it must be noted that the notion of " with the consent or acquiescence of a public official " contained in the Convention definition is absent from the Azerbaijani definition.

The HKSAR should consider adopting a more inclusive definition of the term " public official " in the definition of torture as to clearly include all acts inflicted by or at the instigation of or with the consent or acquiescence of all public officials or other persons acting in an official capacity.

1. 1- تتعهد كل دولة طرف بأن تمنع، في أي إقليم يخضع لولايتها القضائية، حدوث أي أعمال أخرى من أعمال المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة التي لا تصل إلى حد التعذيب كما حددته المادة 1، عندما يرتكب موظف عمومي أو شخص آخر يتصرف بصفة رسمية هذه الأعمال أو يحرض على ارتكابها، أو عندما تتم بموافقته أو بسكوته عليها.

(b) Numerous, ongoing and consistent allegations that abductions and enforced disappearances in the Chechen Republic, in particular during antiterrorist operations, are inflicted by or at the instigation or with the consent or acquiescence of public officials or other persons acting in official capacities and the failure to investigate and punish the perpetrators;

4.4 The State party also submits that its Criminal Code as amended prohibits acts of torture committed by officials, such as peace officers, public officers or persons acting at the instigation of, or with the consent or acquiescence of such persons.
٤-٤ وتذكر الدولة الطرف أيضا أن قانون الجنايات بها، بصيغته المعدلة، يحظر ارتكاب أعمال التعذيب من جانب المسؤولين من أمثال أفراد اﻷمن أو المسؤولين الحكوميين أو اﻷشخاص المتصرفين بتحريض من هؤلاء المسؤولين أو بموافقتهم أو إذعانا لهم.
