In order to most effectively rebut the presumption, the reserving State would presumably indicate when making a reservation whether it is willing to be bound without benefit of the reservation if it turns out that the reservation is considered invalid.
ومن أجل دحض هذا الافتراض بأقصى قدر من الفعالية، يفترَض أن تشير الدولة المتحفظة عند إبداء التحفظ إلى ما إذا كانت على استعداد للالتزام بالمعاهدة دون الاستفادة من التحفظ إذا حدث أن اعتبر التحفظ غير صحيح.

Therefore, the Commission considers that the key to the problem is simply the will of the author of the reservation: does the author intend to be bound by the treaty even if its reservation is invalid -- without benefit of the reservation -- or is its reservation a sine qua non for its commitment to be bound by the treaty?

Since a reservation that is null and void has no legal effect, such a treaty relationship can only mean that the reserving State is bound by the treaty as a whole without benefit of the reservation.
ونظرا لعدم وجود أثر قانوني للتحفظ الباطل بحكم القانون، لا يمكن لمثل هذه العلاقة التعاهدية أن تؤدي إلا إلى إلزام الجهة المتحفظة بالمعاهدة برمّتها دون أن يكون في وسعها الاحتجاج بتحفظها.

Suffice it to say that even in dealing with reservations to the Covenant itself the Committee did not take the view that in every case an unacceptable reservation will fall aside, leaving the reserving state to become a party to the Covenant without benefit of the reservation.

In the Special Rapporteur's opinion, this position merits serious consideration in the Guide to Practice since it offers a reasonable compromise between the underlying principle of treaty law -- consent -- and the potential to consider that the author of the impermissible reservation is bound by the treaty without benefit of the reservation.
