8- وفي ضوء الاعتبارات المذكورة أعلاه، تخلص لجنة مناهضة التعذيب، وهي تتصرف بموجب الفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، إلى أن قرار الدولة الطرف بطرد صاحب الشكوى إلى تونس لا يشكل انتهاكا للمادة 3 من الاتفاقية.
