43. Although the Elements of Crimes was a new subject for many delegations because those elements did not exist in the criminal codes of their respective States, sufficient progress had been made in the efforts to add clarity and precision to a number of definitions contained in the Statute, such as the definition of war crimes.
43 - وقال إنه رغم أن أركان الجريمة موضوع جديد لكثير من الوفود لأن هذه الأركان لم تكن موجودة في القوانين الجنائية لكل من هذه الدول، إلا أنه أُحرز تقدم كاف في الجهود المبذولة لإضافة الوضوح والدقة إلى عدد من التعريفات الواردة في النظام الأساسي، من مثل تعريف جرائم الحرب.

It should also trust the experts on procedural matters and not spend too much time discussing the so-called “Elements of Crimes”.
وكذلك ينبغي الاعتماد على الخبراء بالنسبة للمسائل اﻹجرائية وعدم تضييع الوقت في مناقشة " أركان الجريمة " .

It was further stated by some delegations that States, and not judges, should be responsible for legislating the elements of the crimes.

6. At its first two sessions the Preparatory Commission had made considerable progress in the preparation of the elements of crime and the Rules of Procedure and Evidence.
6 - ومضى إلى القول إن اللجنة التحضيرية أحرزت، في دورتيها الأوليين، تقدما كبيرا في إعداد أركان الجريمة والقواعد الإجرائية وقواعد الإثبات.

57. As regards the specification of crimes, the view was expressed that a procedural instrument enumerating rather than defining the crimes would not meet the requirements of the principle of legality (nullum crimen sine lege and nulla poena sine lege) and that the constituent elements of each crime should be specified to avoid any ambiguity and to ensure full respect for the rights of the accused.
٥٧ - وفيما يتعلق بتحديد أنواع الجرائم، أعرب عن وجهة نظر مفادها أن وضع صك إجرائي بعدد الجرائم دون تعريفها أمر لا يفي بمتطلبات مبدأ الشرعية )لا جريمة بغير نص، لا عقوبة بغير نص( وأنه ينبغي تحديد أركان الجريمة لتجنب أي غموض ولكفالة احترام حقوق المتهم احتراما كاملا.
