(i) Those who plan or decide upon an attack shall refrain from using cluster munitions where the use of such munitions may be expected, in the circumstances ruling at the time, to cause incidental loss of civilian life, injury to civilians, damage to civilian objects, or a combination thereof which would be excessive in relation to the concrete and direct military advantage anticipated.

7. Each High Contracting Party and party to a conflict shall not launch an attack with cluster munitions which may be expected to cause incidental loss of civilian life, injury to civilians, damage to civilian objects, or a combination thereof, which would be excessive in relation to the concrete and direct military advantage anticipated.
7- يمتنع كل طرف من الأطراف المتعاقدة السامية والطرف في نزاع عن شن أي هجوم باستخدام ذخائر عنقودية قد يتوقع منه أن يتسبب عرضاً في إزهاق أرواح مدنيين أو إصابتهم، أو في إلحاق ضرر بأعيان مدنية، أو في مزيج من ذلك إلى حد يكون مفرطاً مقارنة بالميزة العسكرية الملموسة والمباشرة المنتظرة منه.

(b) those who plan or decide upon an attack shall take all feasible precautions in the choice of means and methods of attack with a view to avoiding, and in any event to minimizing, incidental loss of civilian life, injury to civilians and damage to civilian objects;

8. The key elements of this principle are generally considered to include the following: An attack which may be expected to cause incidental loss of civilian life, injury to civilians, damage to civilian objects, or a combination thereof, which would be excessive in relation to the concrete and direct military advantage anticipated, should be prohibited.
