6.2 The State party further maintains that the complainant must establish that there are substantial grounds for believing that she would be in danger of torture were she to be expelled at present, namely at the time of the assessment of the case by the Committee.

10.2 The issue before the Committee is whether the expulsion of the complainant to Sri Lanka would constitute a violation of the State party's obligation under article 3 of the Convention not to expel or to return a person to another State where there are substantial grounds for believing that he/she would be in danger of being subjected to torture.
10-2 والمسألة المعروضة أمام اللجنة هي ما إذا كان طرد صاحبة الشكوى إلى سري لانكا يخل بالتزام الدولة الطرف بمقتضى المادة 3 من الاتفاقية، التي تنص على عدم جواز طرد أي شخص أو إعادته إلى دولة أخرى إذا توافرت لدى اللجنة أسباب وجيهة تحمل على الاعتقاد بأنه قد يتعرض للتعذيب.

14.1 The Committee must determine whether the extradition of the complainant to Mexico would constitute a violation of the State party's obligation under article 3 of the Convention not to extradite, expel or return a person to another State where there are substantial grounds for believing that he would be in danger of being subjected to torture.
14-1 على اللجنة أن تبت في ما إذا كان تسليم صاحب البلاغ إلى المكسيك يخل بالتزام الدولة الطرف بموجب المادة 3 من الاتفاقية القاضية بعدم تسليم شخص أو طرده أو إعادته إلى دولة أخرى حيث توجد أسباب وجيهة تحمل على الاعتقاد بأنه قد يتعرض للتعذيب.

8.2 The issue before the Committee is whether, in deporting the complainant and his children to the Democratic Republic of the Congo, the State party would be failing to fulfil its obligation under article 3 of the Convention not to expel or to return (refouler) a person to another State where there are substantial grounds for believing that he or she would be in danger of being subjected to torture.

10.3 The Committee recalls its general comment No. 1 on the implementation of article 3 in the context of article 22, in which it states that it is obliged to assess whether there are substantial grounds for believing that the complainant would be in danger of being subjected to torture if he or she were returned to the country concerned.

The decision by the Kyrgyz General Prosecutor's Office complies with the Refugee Convention, as the provisions of the Convention do not apply to any person with respect to whom there are serious reasons for considering that he has committed a serious non-political crime outside the country of refuge prior to his admission to that country.
