As such, the exclusionary rule is not derogable under any circumstances and also applies to States which are not party to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.

If there were not to be close links between the Committee against Torture and the new sub-committee, a proposal could be envisaged that the optional protocol might be opened to ratification or accession also to States which were not parties to the Convention against Torture but were parties to the International Covenant on Civil and Political Rights, which also contained a provision prohibiting torture.

They therefore called on States that have not yet done so to become parties to the Convention against Torture and its Optional Protocol, as well as to the Convention on the Rights of Persons with Disabilities, and to take all other measures aimed at ensuring that all persons with disabilities have the right to enjoy all human rights and are fully protected from torture and cruel, inhuman and degrading treatment and punishment.

(k) To become parties to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment as a matter of priority as well as to give early consideration to signing and ratifying its Optional Protocol and, once parties, to designate or establish truly independent and effective national preventive mechanisms;

We call on all States to become party to the Convention against Torture and make the declarations provided under articles 21 and 22 of the Convention, on interState and individual complaints, in order to maximize transparency and accountability in their fight against torture.

Further, since the prohibition of torture and other ill-treatment is part of customary international law, it follows that the exclusionary rule, as a component of that prohibition, must also apply to States that are not party to the Convention against Torture.
