1 - يجوز لأي من الطرفين أن يرفع دعوى أمام محكمة الاستئناف لإعادة النظر في حكم ما على أساس اكتشاف واقعة حاسمة، كانت لدى إصدار الحكم مجهولة لدى محكمة الاستئناف وكذلك لدى الطرف المطالب بإعادة النظر في الحكم، شريطة ألا يكون الجهل بتلك الواقعة ناشئا عن الإهمال.
