Therefore, international humanitarian law obligations apply to this review of Israel's role in the occupied Palestinian territories, including the Hague Regulations and the Geneva Conventions of 1949, in particular the Fourth Geneva Convention relative to the Protection of Civilian Persons in Time of War.

For the Special Rapporteur, the wall constitutes a violation of Articles 23 (g) and 46 of the Hague Regulations and Articles 47, 49, 50, 53 and 55 of the Fourth Geneva Convention.

There was no mention of deportations as such in the Hague Regulations of 1907, but in his authoritative Commentary, Pictet regarded the absence as being due to the fact that the practice had " fallen into abeyance " .

Bien que les éléments de l’article 28 du Règlement de La Haye ne soient pas décrits de façon détaillée, les conclusions des tribunaux peuvent avoir une valeur indicative.
