In the present communication, the author alleges that her son was denied his rights under several provisions of the Covenant.

The author explains that her son was kept isolated and could not meet with his relatives.

7.3 The Committee notes the author's claims under article 9, according to which her son was kept unlawfully for four weeks on premises of the Ministry of Internal Affairs and that he was charged formally only later.
7-3 وتلاحظ اللجنة ادعاءات صاحبة البلاغ في إطار المادة 9 ومفادها أن ابنها قد احتُجز بصورة غير شرعية لمدة أربعة أسابيع في مبنى تابع لوزارة الداخلية وأنه لم يُتّهم رسمياً إلا بعد ذلك.

In the present case, in view of her son's disappearance on 7 May 1997, the author invokes articles 7, 9 and 16.
وتتذرع صاحبة البلاغ في هذه القضية بالمواد 7 و 9 و 16 نظراً إلى أن ابنها قد اختفى منذ 7 أيار/مايو 1997.

The Court had no clear and unambiguous proof that her son was guilty of the murder.

The first author claims that her son was kicked, beaten with truncheons, handcuffed and hung from the ceiling, beaten on his kidneys and tortured with electric current.
إذ تدعي صاحبة البلاغ الأولى أن ابنها قد رُكِل وضُرب بالهراوى، كما غُلَّت يداه وعُلِّق من السقف وضُرب على كليتيه وعُذِّب بالصعق الكهربائي.

The author claims that her son was tortured before he accepted to write down his confession under duress; during her visits, she noted scars on her son's neck and head, as well as broken ribs.
وتزعم صاحبة البلاغ أن ابنها قد أُرغم على كتابة اعترافاته تحت الإكراه بعد أن تعرّض للتعذيب؛ وتقول إنها لاحظت خلال زياراتها لابنها وجود ندوب على عنقه ورأسه وكسور في ضلوعه.

6.7 As to the author's claim that her son was denied the right of appeal, the Committee notes that Mr. Kurbanov was represented by privately obtained counsel, who did not file a regular cassation appeal.
6-7 وفي ما يتعلق بما تدعيه صاحبة البلاغ من أن ابنها قد حرم من حق الطعن، تلاحظ الدولة الطرف أن السيد كوربانوف كان ممثلاً بمحام خاص ولم يطلب الطعن في الحكم بالنقض بصورة عادية.

The Committee notes the author's claim that her son was held for 22 days at the police station, whereas the law provides for a period of 15 days.
وتحيط اللجنة علماً بادعاء صاحبة البلاغ أن ابنها قد احتجز لمدة 22 يوماً في مركز الشرطة، بينما ينص القانون على فترة احتجاز قدرها 15 يوماً.

2.5 The author also claims that her son was detained unlawfully as after his apprehension on 7 May 2000, he was kept in the Ministry of Security until 20 May 2000.
2-5 كما تدَّعي صاحبة البلاغ أن ابنها قد احتُجز بطريقة غير قانونية، إذ أُبقي عليه في وزارة الأمن عقب توقيفه في 7 أيار/مايو 2000 حتى 20 أيار/مايو 2000.

The Committee notes the author's claim that her son was held for more than 50 days without being informed of the charges against him and that he was not brought before a competent judicial authority during this period, and further, that medical attention was insufficient, and that he was allegedly denied access to the information in his medical records.
وتلاحظ اللجنة أن صاحبة البلاغ قد ادعت أن ابنها قد حبس لأكثر من 50 يوماً دون أن يتم إبلاغه بالتهم الموجهة إليه، وأنه لم يمثل خلال هذه الفترة أمام سلطة قضائية مختصة، وأنه لم يتلق عناية طبية كافية، ولم يسمح له على ما يزعم بالاطلاع على البيانات الواردة في ملفه الطبي.

As no investigation has taken place and having received information herself from a witness that her son had died in prison as a result of torture, she is not satisfied with the State party's current explanation that he has disappeared.
