Several delegations underlined that the European Community was a party to the Convention and the Fish Stocks Agreement and expressed the hope that the discrepancy between the observer status of the European Community and its competencies -- whether exclusive or mixed -- with respect to many issues discussed at the Consultative Process could be resolved.

He informed the Working Group also that the European Community was in the process of harmonizing the waste lists in the European Community's waste shipment regulation with the Basel Convention lists, in keeping with the amendments to the Convention Annexes made by the Conference of the Parties at its sixth meeting.

The Open-ended Working Group had also noted that the European Community and Poland had requested emergency exemptions for laboratory and analytical uses, which had been approved by the Ozone Secretariat, in consultation with the Technology and Economic Assessment Panel, in accordance with the procedures of decision VII/9, paragraph 10.

The Co-Chair recalled that the European Community had put forth at the twenty-eighth meeting of the Open-ended Working Group a draft decision aimed at reducing the amount of methyl bromide used for quarantine and pre-shipment purposes.

The representative noted that the European Community was presenting the proposed decision in response to a suggestion by the Technology and Economic Assessment Panel in its report that there be a review in 2005 of 2006 essential-use exemptions for (CFCs) because of possible changing regulatory circumstances for CFC-containing salbutamol in 2005.

The representative of the European Community noted with satisfaction that, after a long process, the phase-out of CFCs for metered-dose inhalers in non-Article 5 Parties was close to being achieved and confirmed that the European Community would phase out production of CFCs for that purpose by 1 January 2010.
200- ولاحظت الممثلة بارتياح أيضا أن التخلص من استخدام مركبات الكربون الكلورية فلورية في أجهزة الاستنشاق بالجرعات المقننة في الأطراف غير العاملة بموجب المادة 5 أصبح،بعد عملية طويلة، قريبا من التحقيق، وأكدت أن الجماعة الأوروبية ستتوقف عن إنتاج مركبات الكربون الكلورية فلورية لهذا الغرض في 1 كانون الثاني/يناير 2010.

Noting with concern that the European Community has reported consumption of the Annex B, group I, controlled substances (other CFCs) of 533.7 ODP-tonnes in 2006, an amount that is inconsistent with the Protocol's requirement that the Party maintain total phaseout of these substances except to the extent of consumption for approved essential uses,

It is to be noted that the European Community also considers a priori that agreements between undertakings (or concerted practices or decisions by associations of undertakings) that restrict competition are (due to the effect they may have in trade between member States) prohibited (article 81 (1) of the Treaty of Rome) and automatically void " nuls de plein droit " (article 81 (2) of the Treaty of Rome).

In that case the specificity of the EC lies in the fact that the EC and the member States each assume international responsibility with respect to their own competencies.
