٤-١٤ ومن المسلم به أنه ﻷجل تحديد ما إذا كانت هناك أسباب جوهرية للاعتقاد بأن الشخص سيتعرض لخطر التعذيب، فإن على السلطات المختصة أن تراعي " جميع الاعتبارات ذات الصلة بما في ذلك، في حالة الانطباق، وجود نمط مستمر من الانتهاكات الفادحة أو الصارخة أو الجماعية لحقوق اﻹنسان " )الاتفاقية، المادة ٣، الفقرة ٢(.
