1. A procuring entity shall exclude a supplier or contractor from the procurement proceedings if:
1- تستبعد الجهةُ المشترية المورِّدَ أو المقاول من إجراءات الاشتراء في الحالتين التاليتين:

Article 20. Exclusion of a supplier or contractor from the procurement proceedings on the grounds of inducements from the supplier or contractor, an unfair competitive advantage or conflicts of interest
المادة 20- استبعاد المورِّد أو المقاول من إجراءات الاشتراء بسبب تقديمه إغراءات أو من جرّاء مزيّة تنافسية غير منصفة أو بسبب تضارب المصالح

(1) A procuring entity shall exclude a supplier or contractor from the procurement proceedings if:

المادة 21- استبعاد المورِّد أو المقاول من إجراءات الاشتراء بسبب تقديمه إغراءات أو من جرَّاء مزيَّة تنافسية غير منصفة أو بسبب تضارب المصالح

2. Any decision of the procuring entity to exclude a supplier or contractor from the procurement proceedings under this article and the reasons therefor shall be included in the record of the procurement proceedings and promptly communicated to the supplier or contractor concerned.
2- يُدرَجُ أيُّ قرار تتَّخذه الجهةُ المشترية باستبعاد المورِّد أو المقاول من إجراءات الاشتراء بمقتضى هذه المادة، وأسبابُ ذلك الاستبعاد، في سجل إجراءات الاشتراء، ويُسَارَع إلى إبلاغه إلى المورِّد أو المقاول المعني.

الإغراءات المقدَّمة من المورِّدين أو المقاولين (المادة 15 من نص عام 1994)؛ استبعاد المورِّد أو المقاول من إجراءات الاشتراء بسبب تقديمه إغراءات أو من جرّاء مزيّة تنافسية غير منصفة أو بسبب تضارب المصالح (المادة 21 من نص عام 2011))

(2) Any decision of the procuring entity to exclude a supplier or contractor from the procurement proceedings under this article and the reasons therefor shall be included in the record of the procurement proceedings and promptly communicated to the supplier or contractor concerned.
(2) يُدرج أيُّ قرار تتخذه الجهة المشترية باستبعاد المورِّد أو المقاول من إجراءات الاشتراء بمقتضى هذه المادة، وأسباب ذلك الاستبعاد، في سجل إجراءات الاشتراء، ويُسَارع إلى إبلاغه إلى المورِّد أو المقاول المعني.

The grounds listed in subparagraph (d) originate from article 19 that permit the procuring entity to reject an abnormally low submission and from article 20 that require the procuring entity to exclude a supplier or contractor from the procurement proceedings on the grounds of inducement from that supplier or contractor, an unfair competitive advantage or conflicts of interest.
وأما الأسباب المذكورة في الفقرة الفرعية (د) فهي مستمدّة أصلاً من المادة 19 التي تسمح للجهة المشترية برفض ما يُقدَّم من عروض منخفضة الأسعار انخفاضاً غير عادي، ومن المادة 20 التي تقتضي أن تستبعد الجهةُ المشترية المورِّد أو المقاول من إجراءات الاشتراء بناءً على أسباب تتعلق بلجوء ذلك المورِّد أو المقاول إلى أساليب الإغراء، أو بمزية تنافسية غير منصفة، أو بتضارب المصالح.
