446- واعتُرف عموماً بأنه ينبغي أن تتاح للدول درجة معقولة من الحرية للسماح بالأنشطة المراد الاضطلاع بها في إقليمها أو تحت ولايتها أو سيطرتها على الرغم من احتمال إحداثها لضرر عابر للحدود.

1. If a State has reasonable grounds to believe that an activity planned or carried out in the State of origin territory or otherwise under the jurisdiction or control of another State may have a risk of causing significant transboundary harm, the former State may request the latter to apply the provision of article 9 [10].
1- إذا كان لدى إحدى الدول أسباب معقولة تدعو للاعتقاد بأن النشاط المزمع الاضطلاع به أو الجاري تنفيذه في إقليم الدولة المصدر دولة أخرى أو تحت ولايتها أو سيطرتها قد ينطوي على مخاطر التسبب في ضرر جسيم عابر للحدود، جاز للدولة الأولى أن تطلب من الدولة الثانية تطبيق حكم المادة 9 [10].

The provision could go further and add " or otherwise under the jurisdiction or control " , as was done in the articles on prevention of transboundary harm from hazardous activities adopted by the Commission in 2001.

States shall ensure that activities referred to in article 1 are not carried out in their territory or otherwise under their jurisdiction or control without their prior authorization.

Article 3 of the draft articles provided that " the freedom of States to carry on or permit activities in their territory or otherwise under their jurisdiction or control is not unlimited " .
وتنص المادة ٣ من مشروع المواد على أن " حرية الدول في القيام بأنشطة أو السماح بها في إقليمها أو تحت ولايتها أو سيطرتها ليست بلا حدود " .
