The view was expressed that an affected State was not free to impose conditions unilaterally or arbitrarily.

(أ) عدم تجريد الأطفال من حريتهم على نحو غير قانوني أو على نحو تعسفي إلاَّ كملاذ أخير ولأقصر فترة زمنية ملائمة، وضمان أن يكون هذا التجريد في حال حدوثه متفقاً مع القانون؛

However, the Special Rapporteur notes with regret that General Cédras and other military leaders responsible for the numerous extrajudicial, summary or arbitrary executions and other human rights violations in Haiti imputed to them enjoy impunity.

(ب) تقليص فترات التأخر في سير العدالة والإسراع بالمحاكمات والإجراءات الأخرى التي تنطوي على أطفال يدعى أنهم انتهكوا القانون الجنائي أو يتهمون بذلك أو يثبت عليهم ذلك، وتجنب ما يترتب على هذا التأخر من احتجاز الأطفال لفترات طويلة أو على نحو تعسفي لحين محاكمتهم أو الانتهاء من تحقيقات الشرطة؛

In that connection, all States, regardless of whether they were sponsors of the draft resolution, had agreed during the unofficial consultations that extrajudicial, summary or arbitrary executions might occur in any country, whether that country applied the death penalty or not. Hence the need to amend operative paragraph 18.
وأثناء المشاورات غير الرسمية، اتفقت كافة الدول، سواءً كانت مشتركة في تقديم مشروع القرار أم لا، على أن ثمة حالاتٍ للإعدام خارج نطاق القضاء أو بإجراءات موجزة أو على نحو تعسفي يمكن أن تحدث في أي بلد، سواءً كان هذا البلد يطبق، أو لا يطبق، عقوبة الإعدام، وبالتالي، فإن من الضروري أن تُعدَّل الفقرة 18 من مشروع القرار.
