Therefore, in conformity with article 2 of the Covenant, States parties are under an obligation to respect and ensure the application of article 27 to everyone within their territory and under their jurisdiction, whether the person or group of persons are citizens of their countries or not.

1. As soon as possible after the communication has been received, and provided that the individual or group of individuals consent to the disclosure of their identity to the State party concerned, the Committee, working group or rapporteur shall bring the communication confidentially to the attention of the State party and shall request that State party to submit a written reply to the communication.
1- بمجرد ورود رسالة، تقوم اللجنة أو الفريق العامل أو المقرر بإبلاغها سرا للدولة الطرف ومطالبة تلك الدولة برد كتابي عليها، وذلك شريطة موافقة الشخص أو مجموعة الأشخاص على الكشف عن هويته أو هوياتهم للدولة الطرف المعنية.

49. In exercising the abovementioned powers, the Commission may, acting on its own or in response to a complaint made to it by an aggrieved person or group of persons, inquire into an allegation of the infringement of the human rights of such person or group of persons.

175. As a rule, there are no distinctions, exclusions, restrictions or preferences in law, in administrative practices or in practical relationships, between persons or group of persons on the basis of race, color, sex, religion, political opinion, nationality or social origin.

Any person or group of persons should be entitled to seek response action by competent public authorities if neither the operator nor the competent public authorities concerned are taking prompt and effective measures to redress environmental damage, provided that the person or group of persons has a sufficient interest or suffers the impairment of a right if so required by domestic law.
1 - ينبغي أن يكون من حق أي شخص أو مجموعة أشخاص التماس قيام السلطات العامة المختصة بإجراء الجبر إذا لم يتخذ المشغِّل أو السلطات العامة المختصة تدابير فورية وفعالة لتصحيح الضرر البيئي، شريطة وجود مصلحة كافية للشخص أو مجموعة الأشخاص أو معاناة من الإخلال يحقٍ لهم إذا كان القانون الوطني ينص على ذلك.

Thus, according to article 8 of the International Law Commission's draft articles on State responsibility, such circumstances would arise if the person or group of persons are in fact acting on the instructions of, or under the direction or control of a State in carrying out the conduct, the three terms being disjunctive.

Draft article 8 provides in relevant part that the conduct of a person or a group of persons shall `be considered as an act of the State under international law'if `it is established that such person or group of persons was in fact acting on behalf of that State'. 1980 II (Part Two) Yearbook International Law Commission at p. 31.
