1. The weight of a subsequent agreement or subsequent practice as a means of interpretation under article 31, paragraph 3, depends, inter alia, on its clarity and specificity.

Paragraph 1 specifies that the weight to be accorded to a subsequent agreement or subsequent practice as a means of interpretation depends, inter alia, on its clarity and specificity.

3. A decision adopted within the framework of a Conference of States Parties embodies a subsequent agreement or subsequent practice under article 31, paragraph 3, in so far as it expresses agreement in substance between the parties regarding the interpretation of a treaty, regardless of the form and the procedure by which the decision was adopted, including by consensus.
3- يجسد القرار الذي يُعتمد في إطار مؤتمر للدول الأطراف اتفاقاً لاحقاً أو ممارسة لاحقة بمقتضى الفقرة 3 من المادة 31 بقدر ما يعبر عن اتفاق، من حيث الجوهر، بين الأطراف بشأن تفسير معاهدة أياً كان الشكل الذي اتخذه اعتماد القرار والإجراء المتبع في اعتماده، بما في ذلك اعتماده بتوافق الآراء.

(11) The characterization of a subsequent agreement or subsequent practice under article 31, paragraph 3 (a) and (b); as assuming a position regarding the interpretation of a treaty often requires a careful factual and legal analysis.
