يُعتبر، بموجب القانون الدولي، تصرف جهاز تابع لدولة أو جهاز أو وكيل تابع لمنظمة دولية يوضع تحت تصرف منظمة دولية أخرى فعلاً صادراً عن المنظمة الأخيرة، إذا كانت المنظمة تمارس السيطرة الفعلية على ذلك التصرف.

One textual difference is due to the fact that the latter article takes the wording of articles 4 and 5 on State responsibility into account and thus considers the ultra vires conduct of " an organ of a State or a person or entity empowered to exercise elements of governmental authority " , while the present article only needs to be aligned with article 6 and thus more simply refers to " an organ or an agent of an international organization " .
وأحد الفوارق في الصياغة يرجع سببه إلى كون المادة الأخيرة تراعي صيغة المادتين 4 و5 المتعلقتين بمسؤولية الدول، وبالتالي تنظر في التصرف المتجاوز لحدود السلطة الصادر عن " جهاز دولة أو شخص أو كيان مفوض لممارسة عناصر السلطة الحكومية " ، في حين أن المادة قيد النظر لا تحتاج إلا إلى أن تتبع صيغة المادة 6 وبالتالي الإشارة ببساطة إلى " جهاز أو وكيل تابع للمنظمة الدولية " .
