2. 2- تتخذ كل دولة طرف بالمثل من الإجراءات لإقامة ولايتها القضائية على هذه الجرائم في الحالات التي يكون فيها مرتكب الجريمة المزعوم موجوداً في أي إقليم يخضع لولايتها القضائية ولا تقوم بتسليمه عملاً بالمادة 8 إلى أية دولة من الدول التي ورد ذكرها في الفقرة 1 من هذه المادة .

7. The Committee also understands that the concept of " any territory under its jurisdiction, " linked as it is with the principle of non-derogability, includes any territory or facilities and must be applied to protect any person, citizen or non-citizen without discrimination subject to the de jure or de facto control of a State party.
7- وتدرك اللجنة أيضاً أن مفهوم " أي إقليم يخضع لولايتها القضائية " ، الذي يرتبط بمبدأ عدم جواز التقييد، يشمل أي إقليم أو مرافق، ويجب تطبيقه لحماية أي شخص أو مواطن أو غير مواطن دون تمييز رهناً بالسيطرة التي تمارسها الدولة الطرف بحكم القانون أو بحكم الواقع.

7 - وتُدرك اللجنة أيضاً أن مفهوم " أي إقليم يخضع لولايتها القضائية " ، الذي يرتبط بمبدأ عدم الانتقاص، يشمل أي إقليم أو مرافق، ويجب تطبيقه لحماية أي شخص أو مواطن أو غير مواطن دون تمييز رهناً بالسيطرة التي تمارسها الدولة الطرف بحكم القانون أو بحكم الواقع.

Under article 16 of the Convention, " [e]ach State Party shall undertake to prevent in any territory under its jurisdiction other acts of cruel, inhuman or degrading treatment or punishment which do not amount to torture as defined in article I, when such acts are committed by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity (emphasis added). "

84. Several proposals were put forward for draft article 9, paragraph 1 (d), on the establishment of State jurisdiction when " the alleged perpetrator of the offence is in a territory under its jurisdiction, unless the State extradites him or her or transfers him or her to an international criminal tribunal " .
84- وتمت صياغة عدة اقتراحات بشأن الفقرة الفرعية (د) من الفقرة 1 من مشروع المادة 9، التي تقر اختصاص الدولة " عندما يكون المرتكب المزعوم للجريمة موجوداً في أي إقليم يخضع لولايتها القضائية إلا إذا سلمته أو أحالته إلى محكمة جنائية دولية " .

In their concluding observations, different committees have urged States parties to recognize and ensure that the human rights treaties apply at all times, in any territory under their jurisdiction.
