١١٥ - وفيما يتعلق بالفقرة ٣، رئي أن الحد الذي يجوز عنده مباشرة التحقيق منخفض على نحو مفرط، إذ يجوز للدولة تقديم شكوى دون إجراء أي تحقيق أو تقديم أي دليل، وأن المدعي العام لا يتمتع بسلطة تقديرية كافية لتحديد ما إذا كانت الشكوى تستدعي مباشرة المحكمة للتحقيق دون إعفاء المتهم ﻷغراض تتعلق بالملاحقة القضائية الوطنية.
