In the case of a transfer of funds from a bank account initiated by the grantor, the law should provide that the transferee of the funds takes free of a security right in the right to payment of funds credited to the bank account, unless the transferee has knowledge that the transfer violates the rights of the secured creditor under the security agreement.
103- في حال إحالة للأموال من حساب مصرفي يستهلها المانح، ينبغي أن ينص القانون على أن من تحال إليه الأموال يأخذها خالية من أي حق ضماني في حق الحصول على سداد الأموال المودعة في الحساب المصرفي، ما لم يكن المحال إليه على علم بأن الإحالة تنتهك ما للدائن المضمون من حقوق بمقتضى الاتفاق الضماني.

The law should provide that an acquisition security right in a separate tangible asset that continues in a mass or product and is effective against third parties has priority as against a security right granted by the same grantor in the mass or product.
89- ينبغي أن ينص القانون على أن الحق الضماني الاحتيازي في الموجودات الملموسة المنفصلة الذي يظل قائما في كتلة البضاعة أو المنتج ويكون نافذا تجاه الأطراف الثالثة تكون له الأولوية على أي حق ضماني منحه نفس المانح في كتلة البضاعة أو المنتج.

If the transferee's secured creditor or the buyer found no security right in the registry, it was not encumbered by the existing right.
فإذا لم يجد الدائن المضمون للمنقول إليه أو المشتري أي حق ضماني في السجل، فهذا يعني أنه ليس مرهونا بالحق القائم.
