78- وتتضح المساواة في الفرص التي تشمل القطاعين العام والخاص أيضاً في كثير من الأشكال التشريعية مثل إعلان العمل لإريتريا رقم 118/2001.

Article 41 (1) of the Labour Proclamation provides that:-

Pursuant to the same text, Articles 156 and 157 provide that who so ever violates the above mentioned provisions of the Labour law shall be penalized under the provisions of the Labour Proclamation and the Penal Code of Eritrea.
174- وعملاً بهذا الإعلان نفسه، تنص المادتان 156 و157 على معاقبة كل من ينتهك الأحكام المذكورة أعلاه من قانون العمل بموجب أحكام إعلان العمل وقانون العقوبات لإريتريا.

Under Article 5 of the Labour Proclamation, 2001, a job seeker can apply for a job through the employment services unit of the Ministry or a private employment agency, or directly to the employer.
183- تنصّ المادة 5 من إعلان العمل لعام 2001 على أن الباحث عن عمل يستطيع التقدُّم بطلبه عن طريق وحدة خدمات العمالة بالوزارة أو عن طريق وكالة عمالة خاصة، أو أن يقدِّم الطلب مباشرة إلى صاحب العمل.
