The Committee is accordingly of the view that the material before it suggests that insufficient weight was given to the authors' allegations of torture and the real risk they might face if deported to their country of origin, in the light of the documented prevalence of torture in Sri Lanka.

4.14 The State party recalls the Committee's jurisprudence that while past torture is one of the elements to be taken into account when examining a claim under article 3 of the Convention, the aim of the examination is to determine whether the complainants would risk being subjected to torture if returned to their country at the present time.
4-9 وإذ تشير الدولة الطرف إلى ما جاء في حكم سابق للجنة من أن التعرض للتعذيب في ما مضى هو من العناصر التي ينبغي أن تؤخذ في الاعتبار لدى البت في ادعاء بموجب المادة 3 من الاتفاقية، فإنها تذكّر بأن الهدف من فحص البلاغ هو تحديد ما إذا كان صاحبا البلاغ سيتعرضان للتعذيب إذا أعيدا إلى بلدهما في الوقت الحالي().

6.3 In relation to the alleged violation of article 17, paragraph 1, and article 23 of the Covenant, the Committee notes that other than statements on the alleged hardship that the children, who were born and raised in the Netherlands, would suffer if they follow their parents to their country of origin, the authors have provided no arguments on how their rights under these provisions would allegedly be violated.

2.6 The authors submitted their pre-removal risk assessment (PRRA) application on 11 April 2007, which was rejected on 28 December 2007 (communicated to the authors on 13 February 2008) on the basis that there was no evidence that the LTTE pursued people who refused to carry out low-level ancillary activities and that the authors therefore could not be considered at risk in case of return to their country of origin.
