١ - تكفل دائرتا المحاكمة أن تكون المحاكمة عادلة وسريعة، وأن تسير الدعوى وفقا للقواعد اﻹجرائية وقواعد اﻹثبات مع احترام حقوق المتهم احتراما كاملا وإيلاء الاعتبار الواجب لحماية المجنى عليهم والشهود.

In the interest of ensuring a fair trial, there should be a balance between an effective prosecution and respect for the rights of the accused or suspect with a view to applying the standards set in the relevant human rights instruments.
٧٦ - ومن أجل تأمين المحاكمة العادلة نبه إلى ضرورة إيجاد التوازن بين المقاضاة الفعالة وبين احترام حقوق المتهم أو المشتبه فيه بقصد تطبيق المعايير الواردة في الصكوك ذات الصلة المتعلقة بحقوق اﻹنسان.

55. Several delegations expressed a preference for an exhaustive rather than an illustrative definition of the crimes so as to ensure respect for the principle of legality, to provide greater certainty and predictability regarding the crimes that would be subject to international prosecution and adjudication and to ensure respect for the rights of the accused.
٥٥ - أعربت عدة وفود عن تفضيلها للتعريف الحصري للجرائم على التعريف الموضوع على سبيل المثال بما يكفل احترام مبدأ القانونية، ويوفر مزيدا من اليقين والقدرة على التنبؤ فيما يتعلق بالجرائم التي تخضع للتقاضي والفصل فيها في إطار محاكمة دولية، ويكفل احترام حقوق المتهم.

15. ١٥ - أعربت عدة وفود عن تفضيلها للتعريف الحصري للجرائم على التعريف الموضوع على سبيل المثال بما يكفل احترام مبدأ القانونية، ويوفر مزيدا من اليقين والقدرة على التنبؤ فيما يتعلق بالجرائم التي تخضع للتقاضي والفصل فيها في إطار محاكمة دولية، ويكفل احترام حقوق المتهم.

The Single Judge or Trial Chambers conducting a trial shall ensure that the trial is fair and expeditious and that proceedings are conducted in accordance with the Rules of Procedure and Evidence, with full respect for the rights of the accused and due regard for the protection of victims and witnesses.
1 - يكفل القاضي الوحيد أو الدائرة الابتدائية التي تجري المحاكمة، أن تكون المحاكمة عادلة وسريعة وأن تسير الإجراءات وفقا للقواعد الإجرائية وقواعد الإثبات مع احترام حقوق المتهم احتراما كاملا وإيلاء المراعاة الواجبة لحماية الضحايا والشهود.

57. As regards the specification of crimes, the view was expressed that a procedural instrument enumerating rather than defining the crimes would not meet the requirements of the principle of legality (nullum crimen sine lege and nulla poena sine lege) and that the constituent elements of each crime should be specified to avoid any ambiguity and to ensure full respect for the rights of the accused.
٥٧ - وفيما يتعلق بتحديد أنواع الجرائم، أعرب عن وجهة نظر مفادها أن وضع صك إجرائي بعدد الجرائم دون تعريفها أمر لا يفي بمتطلبات مبدأ الشرعية )لا جريمة بغير نص، لا عقوبة بغير نص( وأنه ينبغي تحديد أركان الجريمة لتجنب أي غموض ولكفالة احترام حقوق المتهم احتراما كاملا.

31. The view was expressed that a procedural instrument enumerating rather than defining the crimes would not meet the requirements of the principle of legality (nullum crimen sine lege and nulla poena sine lege) and that the constituent elements of each crime ought to be specified to avoid any ambiguity and to ensure full respect for the rights of the accused.
١٣ - أعرب عن وجهة نظر مفادها أن وضع صك إجرائي يعدد الجرائم دون تعريفها أمر لا يفي بمتطلبات مبدأ الشرعية )لا جريمة بغير نص، لا عقوبة بغير نص( وأنه ينبغي تحديد أركان الجريمة لتجنب أي غموض ولكفالة احترام حقوق المتهم احتراما كاملا.
