At the time article 16 on State responsibility had been considered, Israel had questioned whether it was appropriate to limit a State's responsibility in situations of aid or assistance only to cases in which the act would be internationally wrongful if committed by that State.

Thus if the condition contained in article 27 (b), that “the act would be internationally wrongful if committed by that State”, is also added to article 28 as an alternative condition to that of unlawful use of force, the coercing State should assume responsibility towards the third State because it would be aware of the possibility of a breach occurring.

38. While support was expressed for the general thrust of articles 16, 17 and 18, it was considered unnecessary that the State which assisted, directed or coerced another State should have done so with knowledge of the circumstances of the act in order to incur responsibility; it should be sufficient that the act in question would be internationally wrongful if committed by that State.
