The State party should facilitate the access of individuals to legal assistance in all criminal proceedings where the interests of justice so require.
ينبغي للدولة الطرف أن تيسر للأفراد سبل الحصول على المساعدة القانونية في جميع الإجراءات الجنائية كلما اقتضت مصلحة العدالة ذلك.

It further recalls that the right of all accused of a criminal charge to defend themselves in person or through legal counsel of their own choosing, or to have legal assistance assigned to them free of charge whenever the interests of justice so require, is provided for by article 14, paragraph 3 (d).
وتُذكّر اللجنة أيضاً بأن الفقرة 3(د) من المادة 14 تنص على حق جميع المتهمين بارتكاب جرائم في الدفاع عن أنفسهم شخصياً أو بواسطة محامين يختارونهم بمحض إرادتهم أو الحصول على مساعدة قانونية من محامين يعيَّنون مجاناً كلما اقتضت مصلحة العدالة ذلك.

Article 6 (3)(c) of the European Convention on Human Rights includes the right of the accused to be given free legal assistance when that person does not have sufficient means to pay for it and the interests of justice so require in the list of " minimum rights " of defendants in criminal proceedings.
وتنص الفقرة (3)(ج) من المادة 6 من الاتفاقية الأوروبية لحقوق الإنسان والحريات الأساسية، في قائمة " الحقوق الدنيا " المكفولة للمدعى عليهم في الإجراءات الجنائية، على حق المتهم في الاستفادة من المساعدة القانونية المجانية إذا لم تكن لديه الموارد المالية الكافية لدفع تكاليفها وإذا اقتضت مصلحة العدالة ذلك.

8. For the purposes of the Principles and Guidelines, the term " legal aid " includes legal advice, assistance and representation for persons detained, arrested or imprisoned, suspected or accused of, or charged with a criminal offence and for victims and witnesses in the criminal justice process that is provided at no cost for those without sufficient means or when the interests of justice so require.
