We have been a leader in formulating both the United Nations Declaration on the Protection of All Persons from Being Subjected to Torture and the Convention against Torture.

The Board examines all the relevant aspects and activities that come within its mandate as laid down by the General Assembly and the Secretary-General, and especially the definition of torture, with special reference to the Declaration on the Protection of All Persons from Being Subjected to Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.

3. Beneficiaries of projects should be victims of torture, as defined in article 1 of the United Nations Declaration on the Protection of All Persons from Being Subjected to Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.

The Committee was mindful that this definition differed from that in the prior Declaration on the Protection of All Persons from Being Subjected to Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, which described torture as " an aggravated and deliberate form of cruel, inhuman or degrading treatment or punishment " .

These consultations are also useful when the Board is required to interpret the Fund's terms of reference in the light of the provisions in article 1 of the Declaration on the Protection of All Persons from Being Subjected to Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, and article 1 of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.

Subsequently, the prohibition was included in the International Covenant on Civil and Political Rights (1966), the Declaration on the Protection of All Persons from Being Subjected to Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (Declaration against Torture) (1975) and the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (Convention against Torture) (1984).

A number of standards had become model treaties, while others, like the Declaration on the Protection of All Persons from Being Subjected to Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, had become legally binding conventions. Standards and norms were acknowledged as useful for developing national legislation, improving legal systems and strengthening international cooperation.

11. The Declaration on the Protection of All Persons from Being Subjected to Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, adopted by General Assembly resolution 3452 (XXX) of 9 December 1975, similarly provides that " [n]o State may permit or tolerate torture or other cruel, inhuman or degrading treatment or punishment.
