In order to proceed with the formal adoption of the guidelines for children without parental care by the General Assembly, her Committee called on States parties to discuss the guidelines among themselves.

24. UNICEF welcomed the fact that the situation of persons with disabilities and the promotion and protection of the rights of children without parental care now had a place on the international human rights agenda.

361. The right and duty of parents to provide for the subsistence and education of children and the special protection of orphans or children without parental care is envisaged in article 40 of the Constitution.

529. At its 976th meeting, held on 15 September 2004, the Committee adopted a decision regarding children without parental care (see chap. I).

The decision recommended, inter alia, that the Commission on Human Rights at its sixty-first session, consider establishing a working group to prepare draft United Nations guidelines for the protection and alternative care of children without parental care.
وأوصى المقرر، في جملة أمور، بأن تنظر لجنة حقوق الإنسان في دورتها الحادية والستين، في إنشاء فريق عامل يتولى إعداد مشروع مبادئ توجيهية للأمم المتحدة من أجل حماية الأطفال المحرومين من الرعاية الأبوية وتوفير الرعاية البديلة لهم.

The recently adopted Guidelines for the Alternative Care of Children are intended to enhance the implementation of the Convention on the Rights of the Child and other international instruments regarding the protection and well-being of children deprived of parental care.

435- وتوجَد من ضمن أغلبية الأطفال المحرومين من الرعاية الأبوية نسبة 54 في المائة من الأطفال الذين تولى أحد الوالدين تنشئتهم: شكلت الأم نسبة 46 في المائة، في حين شكل الأب نسبة 8 في المائة.

The Committee notes with regret in this regard that, apart from the body set up in 1999 to coordinate the affairs of children deprived of parental care, no standing national mechanism has been established to ensure effective coordination of activities in the field of children's rights between ministries, local authorities and non-governmental organizations.
وتلاحظ اللجنة بأسف في هذا الصدد أنه لم تُنشأ أي آلية وطنية دائمة لضمان التنسيق الفعال لأنشطة حقوق الإنسان فيما بين الوزارات والسلطات المحلية والمنظمات غير الحكومية، باستثناء الهيئة المنشأة في عام 1999 لتنسيق شؤون الأطفال المحرومين من الرعاية الأبوية.

According to the Article 31 of the Law of the Republic of Azerbaijan " On the rights of the child " , protection of children deprived of parental care is ensured by their adoption, giving them to patronage, guardianship and other families and if not possible then placing them in relevant institutions.
١٩٣- وتنص المادة ٣١ من قانون جمهورية أذربيجان بشأن " حقوق الطفل " على كفالة حماية الأطفال المحرومين من الرعاية الأبوية عن طريق تبنيهم، أو وضعهم في عهدة أسر تتكفل بتربيتهم ورعايتهم، أو وضعهم في المؤسسات المعنية إذا لم يتيسر ذلك.
