A particular investigation technique was counted only if it was generally applicable for the offences established in accordance with the Convention:

- Extend the list of predicate offences set forth in the MLPA to include all the offences established under the Convention;
- توسيع قائمة الجرائم الأصلية في قانون منع غسل الأموال لتشمل جميع الأفعال المجرمة في الاتفاقية؛

Under Libyan law any funds that are unlawful as to their source, cause, purpose or manner of use may be frozen; therefore any funds used for terrorist acts or other criminal acts may be frozen or seized.
- وفقا للقانون الليبي فإن أي مال غير مشروع في مصدره أو سببه أو غايته أو وسيلة استخدامه يمكن تجميده، ومن ثم فإنه يمكن تجميد أو مصادرة الأموال المستخدمة في الأعمال الإرهابية أو الأفعال المجرمة الأخرى.

1. Each State Party shall adopt such measures as may be necessary, consistent with its legal principles, to establish the liability of legal persons for participation in the offences established in accordance with this Convention.
1- تعتمد كل دولة طرف ما قد يلزم من تدابير، بما يتفق مع مبادئها القانونية، لإرساء مسؤولية الهيئات الاعتبارية عن المشاركة في الأفعال المجرمة وفقا لهذه الاتفاقية.

5. In order to facilitate the recovery of proceeds of offences established in accordance with this Convention, States Parties may cooperate in providing each other with the names of experts who could assist in achieving that objective.
5- تيسيرا لاسترداد عائدات الأفعال المجرمة وفقا لهذه الاتفاقية، يجوز للدول الأطراف أن تتعاون على تزويد بعضها البعض بأسماء الخبراء الذين يمكن أن يساعدوا على تحقيق ذلك الهدف.

An exception to this rule are criminal offences established by article 135 (which are subject to the unconditional territorial principle).
وتُستثنى من هذه القاعدة الأفعال المجرمة بموجب المادة 135 (التي تخضع لمبدأ الإقليمية غير المشروط).

6. Nothing contained in this Convention shall affect the principle that the description of the offences established in accordance with this Convention and of the applicable legal defences or other legal principles controlling the lawfulness of conduct is reserved to the domestic law of a State Party and that such offences shall be prosecuted and punished in accordance with that law.
6 - ليس في هذه الاتفاقية ما يمس بالمبدأ القائل بأن توصيف الأفعال المجرمة وفقا لهذه الاتفاقية وتوصيف الدفوع القانونية المنطبقة أو المبادئ القانونية الأخرى التي تحكم مشروعية السلوك، محفوظ حصرا لقانون الدولة الطرف الداخلي، وبوجوب ملاحقة تلك الجرائم والمعاقبة عليها وفقا لذلك القانون.

6. 8. During the sixth session of the Ad Hoc Committee, the consistency group continued to consider the question of choosing between the phrases " offences covered by this Convention " and " offences established in accordance with this Convention " .
8- خلال الدورة السادسة، واصل فريق الاتساق نظره في مسألة المخايرة بين عبارتي " الجرائم المشمولة بهذه الاتفاقية " و " الأفعال المجرمة وفقا لهذه الاتفاقية " .

Having reached the conclusion that it was only a question of terminology, the consistency group decided that those two phrases should be changed to read " offences established in accordance with this Convention " in article 66 and " the commission of an offence established in accordance with this Convention " in article 67 and article 67 bis, paragraph 1.
وإذ خلص الفريق إلى أن هذه المسألة ذات طابع مصطلحي محض، قرّر تغيير تلك العبارة إلى " الأفعال المجرمة وفقا لهذه الاتفاقية " في المادة 66، وإلى " ارتكاب فعل مجرّم وفقا لهذه الاتفاقية " في المادة 67 والفقرة 1 من المادة 67 مكررا.

10. The objective of the organized criminal group is to commit " one or more serious crimes or offences established in accordance with this Convention, in order to obtain, directly or indirectly, a financial or other material benefit " .
١٠- ويكمن هدف الجماعة الإجرامية المنظَّمة في " ارتكاب واحدة أو أكثر من الجرائم الخطيرة أو الأفعال المجرمة وفقا لهذه الاتفاقية، من أجل الحصول، بشكل مباشر أو غير مباشر، على منفعة مالية أو منفعة مادية أخرى " .

4. Each State Party shall take the necessary measures, in accordance with its domestic laws and regulations regarding the maintenance of books and records, financial statement disclosures and accounting and auditing standards, to prohibit the following acts performed for the purpose of committing any of the offences established in articles [...] of this Convention:
4- تتخذ كل دولة طرف، وفقا لقوانينها ولوائحها التنظيمية الداخلية المتعلقة بحفظ الدفاتر والسجلات وكشف البيانات المالية ومعايير المحاسبة ومراجعة الحسابات ما يلزم من تدابير لحظر القيام بالأفعال التالية بغرض ارتكاب أي من الأفعال المجرمة في المواد [...] من هذه الاتفاقية:

4. Each State Party shall take the necessary measures, in accordance with its domestic laws and regulations regarding the maintenance of books and records, financial statement disclosures and accounting and auditing standards, to prohibit the following acts performed for the purpose of committing any of the offences established in articles [...] of this Convention:
4- تتخذ كل دولة طرف، وفقا لقوانينها ولوائحها التنظيمية الداخلية المتعلقة بمسك الدفاتر والسجلات وكشف البيانات المالية ومعايير المحاسبة ومراجعة الحسابات، ما يلزم من تدابير لحظر الأفعال التالية بغرض ارتكاب أي من الأفعال المجرمة في المواد [...] من هذه الاتفاقية:

4. The Government of the Sudan, because it believes in the principle of accountability for criminal acts and wishes to see justice being served, set up a national committee to investigate the incidents that allegedly occurred. The committee, in its final report, recommended among other things that a judicial investigation panel be established.
4- إيماناً بمبدأ المساءلة عن الأفعال المجرمة وتحقيقاً للعدالة فقد قامت حكومة السودان بتشكيل لجنة وطنية لتقصى الحقائق حول الوقائع المدعى ارتكابها، وقد أوصت اللجنة في تقريرها النهائي - من ضمن توصيات أخرى - بإنشاء لجنة تحقيق قضائي.

Any funds that are illegal in terms of their source, reason, purpose or the use that is made of them can be seized under Libyan law. It follows that funds used for terrorist operations can be seized, by being frozen or confiscated. The funds referred to, if they are indeed connected with criminal acts, including acts of terrorism and so forth, can therefore be confiscated and, a fortiori, frozen.
إن أي مال غير مشروع في مصدره أو سببه أو غايته أو وسيلة استخدامه يمكن التحفظ عليه وفقا للقانون الليبي، ومن ثم فإنه يمكن التحفظ على الأموال المستخدمة في الأعمال الإرهابية أي بمعنى تجميدها بل ومصادرتها، وعليه فإن الأموال المشار إليها إذا تعلقت بفعل من الأفعال المجرمة سواء في ذلك الأعمال الإرهابية أو غيرها يمكن مصادرتها ومن باب أولى تجميدها.
