This second element is an aggravated criminal intent, or dolus specialis; it implies that the perpetrator consciously desired the prohibited acts he committed to result in the destruction, in whole or in part, of the group as such, and knew that his acts would destroy, in whole or in part, the group as such.

Article 6 of the articles on the responsibility of States for internationally wrongful acts takes a similar approach, although it is differently worded.

It was reiterated that the term " lawful " in this context should be understood with its double negative connotation, that is " not unlawful acts " , since international humanitarian law did not in a literal sense define which acts were " lawful " , but which acts were prohibited.
