Paragraph (2) of the revised proposal provided that, for future investment treaties, a reference to the UNCITRAL Arbitration Rules in such treaties would be understood as including a reference to the rules on transparency.

After discussion, the Commission agreed that it would not be desirable to include specific provisions on treaty-based arbitration in the UNCITRAL Arbitration Rules themselves and that any work on investor-State disputes which the Working Group might have to undertake in the future should not delay the completion of the revision of the UNCITRAL Arbitration Rules in their generic form.

72. Concerns were expressed that that proposal would not sufficiently take account of the multi-regional applicability of the UNCITRAL Arbitration Rules, and would have the consequence of centralizing all cases where the parties had not designated an appointing authority in the hands of one organization.

Experts on mission holding a consultant contract may avail themselves of the dispute settlement clause provided for in that contract (i.e., normally by amicable settlement, including conciliation under the UNCITRAL Conciliation Rules, and, if that is not successful, by arbitration in accordance with the UNCITRAL Arbitration Rules).
