Legal procedures in Kuwaiti courts of every level are regulated by the Code of Civil and Commercial Procedure No. 38 of 1980 and the Code of Criminal Procedure and Trial No. 17 of 1960.
وينظم إجراءات التقاضي أمام المحاكم الكويتية على اختلاف درجتها القانون رقم 38 لسنة 1980 الخاص بإصدار قانون المرافعات المدنية والتجارية والقانون رقم 17 لسنة 1960 الخاص بإصدار قانون الإجراءات والمحاكمات الجزائية.

The Code of Criminal Procedure and Trials provides that in criminal cases, a penalty may be imposed only after a trial conducted in accordance with the rules and procedures prescribed by law. "
كما نص قانون الإجراءات والمحاكمات الجزائية بأنه لا يجوز توقيع عقوبة جزائية إلا بعد محاكمة تجرى وفقاً للقواعد والإجراءات التي يقررها القانون.

The Code of Criminal Procedure, in accordance with international standards of justice, provides litigants with legal safeguards, including an open trial, the right to be represented by counsel, and other safeguards.
جاء قانون الإجراءات والمحاكمات الجزائية متفقاً مع معايير العدالة الدولية، بحيث كفل للمتقاضين الضمانات القانونية من علانية المحاكمة ووجود محامي وغيره من الضمانات الأخرى.

In any dispute brought before them, the courts therefore apply the constitutional principles and the relevant laws in effect, as well as Act No. 38 of 1980 promulgating the Code of Civil and Commercial Procedure and Act No. 17 of 1960 promulgating the Code of Criminal Procedure and Trial.
هذا ويطبق القضاء في المنازعات المطروحة أمامه القواعد الدستورية والقوانين النافذة ذات الصلة والقانون رقم 38 لسنة 1980 الذي صدر به قانون المرافعات المدنية والتجارية والقانون رقم 17 لسنة 1960 الذي صدر به قانون الإجراءات والمحاكمات الجزائية.

CAT noted with concern that certain provisions in the Code of Criminal Procedure and the Prison Regulation Act providing legal safeguards to detainees were little respected.
46- ولاحظت لجنة مناهضة التعذيب بقلق ضعف التقيّد بأحكام معيّنة من قانون الإجراءات والمحاكمات الجزائية وقانون تنظيم السجون تمنح المحتجزين ضمانات قانونية.

58. Article 105 of the Code of Criminal Procedure provides that: " The court shall base its decision on evidence gathered from its investigation into the case or from pre-trial investigations. The court shall have complete freedom to weigh the evidence in reaching its decision.
58- تنص المادة 105 من قانون الإجراءات والمحاكمات الجزائية على أن " تعتمد المحكمة في اقتناعها على الأدلة المستخلصة من التحقيق الذي أجرته في القضية أو من التحقيقات السابقة على المحاكمة، ولها الحرية المطلقة في ترجيح دليل على دليل وتكوين قناعتها.

The Committee is further concerned at the provisions of article 49 of the Code of Criminal Procedure which allows for the use of excessive force on death row detainees (arts. 2 and 16).
كما تشعر اللجنة بالقلق إزاء أحكام المادة 49 من قانون الإجراءات والمحاكمات الجزائية التي تُجيز الاستخدام المفرط للقوة على المحتجزين الذين ينتظرون تنفيذ عقوبة الإعدام (المادتان 2 و16).

56. In addition, the Code of Criminal Procedure and Trials, in accordance with international standards of justice, provides litigants with legal safeguards, including an open trial, the right to be represented by counsel, and other safeguards that ensure a fair trial.
56- كما جاء قانون الإجراءات والمحاكمات الجزائية متفقاً مع معايير العدالة الدولية بحيث وفر للمتقاضين الضمانات القانونية من علانية المحاكمة ووجود محامٍ وغيرهما من الضمانات الأخرى التي تكفل له المحاكمة العادلة.

The Committee is further concerned at the provisions of article 49 of the Code of Criminal Procedure which allows for the use of excessive force on death row detainees (arts. 2 and 16).
كما تشعر اللجنة بالقلق إزاء أحكام المادة 49 من قانون الإجراءات والمحاكمات الجزائية التي تُجيز الاستخدام المفرط للقوة ضد المحتجزين في انتظار تنفيذ عقوبة الإعدام فيهم (المادتان 2 و16).

106. Legal proceedings in Kuwaiti courts of all levels are regulated by the Code of Civil and Commercial Procedure No. 38 of 1980 and the Code of Criminal Procedure No. 17 of 1960. The provisions of both Codes apply to all litigants, without distinction between men and women.
106- وينظم إجراءات التقاضي أمام المحاكم الكويتية على اختلاف درجاتها القانون رقم 38 لسنة 1980 الخاص بإصدار قانون المرافعات المدنية والتجارية والقانون رقم 17 لسنة 1960 الخاص بإصدار قانون الإجراءات والمحاكمات الجزائية واللذان تسري أحكامها على جميع المتقاضين لا فرق في ذلك بين الرجال والنساء.

In 2012, Kuwait reported that it had tabled a bill to amend the Code of Criminal Procedure so as to reduce the length of police custody to 24 hours instead of four days and also to reduce the term of pretrial detention from three weeks to one.
وفي عام 2012، ذكرت الكويت أنها عرضت على مجلس الأمة مشروع قانون لتعديل قانون الإجراءات والمحاكمات الجزائية من أجل تقليل مدة الاحتجاز لدى الشرطة إلى 24 ساعة بدلاً من أربعة أيام، وأيضاً من أجل تقليل مدة الاحتجاز السابق للمحاكمة من ثلاثة أسابيع إلى أسبوع واحد(92).

168. Act No. 3 of 2012 amended some provisions of the Code of Criminal Procedure (Act No. 17 of 1960) in a manner consistent with article 9 of the International Covenant on Civil and Political Rights, as already noted in a preceding section of this report to which reference can be made.
