The Declaration on Minorities does not provide a comprehensive or legally binding definition of which groups can be considered to constitute minorities or provide detailed criteria for according minority status.

It specifies that the beneficiaries of the rights under article 27 of the International Covenant on Civil and Political Rights, which inspired the Declaration, are persons belonging to " ethnic, religious or linguistic minorities " and that the Declaration on Minorities adds the criterion " national minorities " .
