Having recalled its earlier deliberation of the matter of incorporation by reference, and the draft texts proposed as its previous sessions (A/CN.9/WG.IV/WP.71, paras. 77-93), the Working Group was invited to consider the matter of incorporation by reference in an electronic context on the basis of a proposed draft provision (A/CN.9/WG.IV/WP.74, Annex), which read as follows:

While it was admitted that incorporation by reference created certain risks, e.g., for consumers, it was argued that, at the same time, such practice allowed consumers to take advantage of opportunities offered only via electronic communication networks.
