55. The Appeals and Legal Advisory Division of the Office of the Prosecutor continues to experience an increase in workload.

The staff complement in the Appeals and Legal Advisory Division is divided into three main teams, each handling a number of appeals, potential appeals and interlocutory appeals.

Owing to staffing constraints within the Mechanism, staff designated from the International Criminal Tribunal for Rwanda Appeals and Legal Advisory Division successfully defended the first appeal before the Mechanism Appeals Chamber, brought in respect of the decision by the Tribunal to transfer the case of Phineas Munyarugarama to Rwanda for trial.

In addition to the new trials, efforts of the Office of the Prosecutor focus on the increasing workload of its Appeals and Legal Advisory Division, as it is expected that every judgement passed by the Trial Chamber, save for those in which the indictee has pleaded guilty, will be challenged on appeal by the Defence and in some cases appeals will also be filed by the Office.
