In resolutions 7/7 and 10/15, of 27 March 2008 and 26 March 2009 respectively, the Council inter alia reaffirmed the nonderogability of certain rights in all circumstances, as well as the exceptional and temporary nature of derogations.
ففي القرارين 7/7 و 10/15 المؤرخين 27 آذار/مارس 2008 و 26 آذار/مارس 2009 على التوالي، أكد المجلس من جديد، في جملة أمور، عدم جواز التقييد لحقوق معينة في جميع الأحوال كما أكد الطابع الاستثنائي والمؤقت لحالات التقييد.

(d) In the eighth preambular paragraph (now tenth), the words " must be of an exceptional and temporary nature, and in all cases in accordance with that article " were replaced by the words " must be in accordance with that article in all cases, and underlining the exceptional and temporary nature of any such derogations " ;

In its general comment No. 29, the Human Rights Committee highlighted the exceptional and temporary character of derogations, stating that the Covenant required that, even during an armed conflict, measures derogating from the Covenant were allowed only if and to the extent that the situation constituted a threat to the life of the nation.
وبيّنت اللجنة المعنية بحقوق الإنسان في تعليقها العام رقم 29() الطابع الاستثنائي والمؤقت لعدم التقيد موضحة أن العهد يشترط، حتى في حالة الصراع المسلح، عدم جواز اتخاذ تدابير لا تتقيد بالعهد إلا إذا كانت هذه الحالة تشكل تهديداً على حياة الأمة وبقدر ما تشكل هذا التهديد.

It further reaffirmed the obligation of States to respect certain rights as non-derogable in any circumstances and recalled that any measures derogating from the provisions of the International Covenant on Civil and Political Rights (see General Assembly resolution 2200 A (XXI), annex) must be in accordance with the prescribed limitative conditions, and underlined the exceptional and temporary nature of any such derogations.
