The suggestion was also made that the Model Law should require the procuring entity to notify suppliers or contractors, promptly upon request, of the reasons justifying the procuring entity's decision to have recourse to domestic procurement, to ensure effective review of that decision.
واقتُرح أيضا أن يلزم القانون النموذجي الجهة المشترية بإشعار المورّدين أو المقاولين، فورا بناء على الطلب، بالأسباب المبرّرة لقرارها باللجوء إلى الاشتراء المحلي ابتغاء كفالة إعادة النظر في هذا القرار بصورة فعّالة.

If this wording is retained, the procuring entity would be able to lift the additional requirement only in the case of domestic procurement or where it decides, in view of the low value of the subject matter of the procurement, that only domestic suppliers or contractors are likely to be interested in participating in the procurement proceedings.

The relevance of information listed in subparagraph (s) should however be assessed in domestic procurement.

The application of the article would therefore not necessarily lead to the limitation of participation on the basis of nationality (such as to the domestic procurement).
ومن ثمّ لا يؤدي تطبيق هذه المادة بالضرورة إلى الحدّ من المشاركة على أساس الجنسية (كما هي الحال بالنسبة إلى الاشتراء المحلي).

4. The procurement regulations must address in detail exceptions to the general rule on publication of the invitation internationally -- domestic procurement or where procurement in view of its low value, in the judgement of the procuring entity, is unlikely to be interest on the part of foreign suppliers or contractors.
4- ويجب أن تتناول لوائح الاشتراء بالتفصيل استثناءات القاعدة العامة بشأن نشر الدعوات دوليا - أي الاشتراء المحلي أو عندما ترى الجهة المشترية أن الاشتراء لن يثير على الأرجح اهتمام المورِّدين أو المقاولين الأجانب بسبب تدني قيمته.

4. The procuring entity shall not be required to cause the invitation to be published in accordance with paragraph 2 of this article in domestic procurement and in procurement proceedings where the procuring entity decides, in view of the low value of the subject matter of the procurement, that only domestic suppliers or contractors are likely to be interested in presenting submissions.
4- لا تُلزَم الجهة المشترية بالتكَفُّل بنشر الدعوة وفقاً للفقرة 2 من هذه المادة في إجراءات الاشتراء المحلي وإجراءات الاشتراء التي تُقرِّر فيها الجهة المشترية، بالنظر إلى القيمة المنخفضة للشيء موضوع الاشتراء، أنَّ المورّدين أو المقاولين المحليين وحدهم هم الذين يُرجَّح أن يهتموا بتقديم عروض فيها.

In article 16, paragraph 1 (c) (ii) seems to be superfluous because the introduction of (c) already contains a reference to (b) where domestic procurement is addressed.
وفي المادة 16، يبدو أنَّ الفقرة 1 (ج) `2` زائدة، لأنَّ العبارة الاستهلالية في الفقرة الفرعية (ج) تتضمن بالفعل إشارة إلى الفقرة الفرعية (ب) التي تتناول الاشتراء المحلي.

3. Paragraph (1) does not mean " domestic procurement " only in the sense that domestic suppliers or contractors alone, however they may be defined in the enacting State, are permitted to participate in the procurement proceedings (noting that domestic procurement removes the obligation of international solicitation under article 32).
3- و " الاشتراء المحلي " في الفقرة (1) لا يقتصر معناه على أنَّ المورِّدين والمقاولين المحليين، بغضّ النظر عن تعريفهم لدى الدولة المشترعة، هم وحدهم الذين يُسمح لهم بالمشاركة في إجراءات الاشتراء (مع ملاحظة أنَّ الاشتراء المحلي يزيل التزام الالتماس الدولي بمقتضى المادة 32).

The limited exceptions to international solicitation are those that apply to other procurement methods requiring open solicitation and are listed in article 32 (4) (domestic procurement in accordance with article 8 and cases of low-value procurement.
وتتمثل الاستثناءات المحدودة للالتماس الدولي في تلك المنطبقة على سائر أساليب الاشتراء التي تستدعي إجراء التماس مفتوح وهي ترد في المادة 32 (4) (الاشتراء المحلي وفقا للمادة 8 وحالات الاشتراء ذات القيمة المنخفضة.

Mr. Fruhmann (Austria), referring to article 16, proposed that subparagraph (1)(c)(ii) be deleted as subparagraph (1)(b) already covered the question of the issuing of a tender security in cases of domestic procurement.
17- السيد فرومان (النمسا): اقترح أن تحذف من المادة 16 الفقرة الفرعية (1) (ج) `2` بما أنَّ الفقرة الفرعية (1) (ب) تشمل أصلا، على حدّ قوله، مسألة إصدار ضمانة عطاء في حالات الاشتراء المحلي.

(b) That it should be redrafted or deleted to avoid providing for the automatic right to have recourse to domestic procurement in case of low-value procurement.

The paragraph may cover, as paragraph (1) does, domestic procurement (e.g. procurement with participation of only suppliers or contractors coming from disadvantaged areas within the same State) or international procurement limited to certain groups of suppliers or contractors (e.g. persons with disabilities).
وهذه الفقرة، شأنها شأن الفقرة (1)، يمكن أن تشمل الاشتراء المحلي (على سبيل المثال الاشتراء الذي لا يشارك فيه سوى المورِّدين أو المقاولين الآتين من مناطق مغبونة داخل الدولة نفسها) أو الاشتراء الدولي المحصور في فئات معيّنة من المورِّدين أو المقاولين (مثل الأشخاص المعاقين).()

In the light of the amendments agreed to be made to the definition of " domestic procurement " (see paragraph 20 above), the Secretariat was requested to amend article 8 to include a reference to low-value procurement as a reason justifying recourse to domestic procurement.
