Text of the resolution: States shall: " Take appropriate measures in conformity with relevant provisions of national and international law, including international standards of human rights, before granting refugee status, for the purpose of ensuring that the asylum-seeker has not planned, facilitated or participated in the commission of terrorist acts; "

Paragraph 3 (f): [Calls upon all States to] take appropriate measures in conformity with the relevant provisions of national and international law, including international standards of human rights, before granting refugee status, for the purpose of ensuring that the asylum-seeker has not planned, facilitated or participated in the commission of terrorist acts;

Thus, when examining future applications for refugee status, the Ministry will take due account of paragraph 3 of Security Council resolution 1373 (2001) and, in particular, will take all available measures to ensure that " the asylum-seeker has not planned, facilitated or participated in the commission of terrorist acts " .

Perpetration or co-perpetration of international crimes

Specifically, the relevant provisions in the Penal Code relate to murder, manslaughter, causing an explosion, rape, robbery and causing bodily harm as well as any attempt to commit or instigate such offences or complicity in their commitment.
