Regarding the nature of crimes for which a State could be held responsible, his delegation agreed with the concept elucidated in, but not limited to, draft article 19 of Part One of the draft articles.

5. Several delegations commented on the spirit in which the Commission should approach the distinction between delicts and wrongful acts characterized as crimes in article 19 of Part One of the draft articles.

The link between article 19 of Part One of the draft articles on State responsibility should also be taken into account, since the actions of individuals contributed significantly to the perpetration of crimes by States.

17. On the topic of State responsibility, the question of the legal consequences of internationally wrongful acts characterized as crimes under article 19 of Part One of the draft articles raised legal issues and politically sensitive matters which would have to be addressed.
٧١ - وفيما يتعلق بموضوع مسؤولية الدول، قال إن مسألة اﻵثار القانونية المترتبة على اﻷفعال غير المشروعة دوليا التي توصف بأنها جنايات بموجب المادة ٩١ من الباب اﻷول من مشروع المواد تثير قضايا قانونية ومسائل حساسة سياسيا يتعين معالجتها.

STATE RESPONSIBILITY 1. According to plans, the coming session of the Commission is to devote part of its time to a debate on the consequences of State crimes, as defined in article 19 of Part One of the draft articles on State responsibility: this on the basis of the Special Rapporteur's fifth report (A/CN.4/453/Add.2 and 3).

In any case, his delegation sought clarification as to whether the crimes encompassed by the Code were the same ones the Commission considered to be crimes when discussing State responsibility or whether they were different, so that the only ones giving rise to aggravated international responsibility would be those in article 19 of Part One of the draft articles.

Question (4), namely whether article 19 of Part One of the draft articles provided an adequate basis for the continuation of work, elicited a positive response from a number of representatives, who found the text carefully worded and generally satisfactory subject to possible improvements based on developments in State practice or in the light of the consequences to be attached to the commission of an international crime.
٢٥ - وقد رد عدد من الممثلين باﻹيجاب على السؤال )٤(، ألا وهو ما إذا كانت المادة ١٩ من الباب اﻷول من مشروع المواد توفر أساسا كافيا لمواصلة العمل، حيث رأوا أن النص قد صيغ بحرص وأنه مقبول بوجه عام وإن كان يمكن ادخال تحسينات عليه على أساس ما وقع من تطورات في ممارسة الدول أو على ضوء النتائج التي يتقرر أنها تترتب على ارتكاب جريمة دولية.

This might actually be justified even in the framework of an instrument of a declaratory nature if general principles, for the most part soundly based on customary law, are involved, as is the case for part I of the draft articles.
وقد يكون ذلك مبررا فعلا حتى في إطار صك ذي طبيعة إيضاحية إذا ما وردت فيه مبادئ عامة يستند معظمها بشكل سليم إلى القانون العرفي، كما هو الحال في الباب اﻷول من مشروع المواد.
