78. In that connection, it was noted that in a paper-based environment, presentation could mean presentation for performance as well as for other purposes, such as presentation of a bill of exchange for acceptance.
78- وأُشير، في هذا الصدد، إلى أنَّ التقديم في البيئة الورقية يمكن أن يعني التقديم بغرض المطالبة بالأداء أو لأغراض أخرى، مثل تقديم كمبيالات بغرض القبول.

In particular, proposals were made based on a functional approach, thus encompassing instruments that did not necessarily exist in the paper-based environment but would achieve similar functions, such as to evidence a right to claim performance of obligation and to allow for the transfer of rights with the transfer of the electronic record.

32- واتُّفق كذلك على أنَّ قرارَ الفريقِ العاملِ المشارَ إليه أعلاه لا يُلمِح على أيِّ نحو كان إلى أنَّ الفريق العامل بصدد إعداد أحكام موضوعية بشأن الصكوك التي لا وجود لها في البيئة الورقية.

With respect to draft article 13, it was noted that uniqueness was a notion in the paper-based environment, its aim being to entitle a single holder to the performance of an obligation.
51- فيما يخص مشروع المادة 13 لوحظ أنَّ التفرُّد مفهومٌ موجودٌ في البيئة الورقية وأنَّ غرضه هو إعطاءُ حائزٍ وحيد حقَّ المطالبة بأداء التزام.

In response, it was noted that draft article 21 was justified in light of the prominence of the notion of transfer in the paper-based environment.

In response, it was reiterated that whether control of an electronic transferable record was legitimate or not was a matter of substantive law and that the Working Group had understood control to be " factual " , so as to achieve the functional equivalence of " factual or physical " possession in a paper-based environment.
