It is in this sense that the term has been applied in the African context by the Working Group on Indigenous Populations/Communities of the African Commission on Human and Peoples' Rights, and this is also the intent of the Special Rapporteur's recommendations to African countries.

On the basis of the discussion that took place at that meeting, the Special Rapporteur plans to visit Kenya in September 2013 to meet with members of the African Commission's Working Group on Indigenous Populations/Communities in Africa, to discuss strategies for implementation of the Commission's principal decision to date regarding indigenous peoples, its decision in the case of the Endorois Welfare Council vs. Kenya.
