The Summit also recommends that States should take and implement measures to ensure the effective protection of witnesses, collaborators of justice and people close to them from potential intimidation or retaliation.

7. The Special Rapporteur is alarmed at the above-mentioned reports and joins the Human Rights Council in condemning all acts of intimidation or reprisal against individuals that cooperate with the human rights instruments.
7- ويعرب المقرر الخاص عن جزعه إزاء التقارير المذكورة أعلاه ويؤيد مجلس حقوق الإنسان في تنديده لكل أعمال الترهيب أو الانتقام المرتبكة ضد الأفراد الذين يتعاونون مع هيئات حقوق الإنسان().

States are reminded of their obligation under article 13 (3) of the Declaration to protect against ill-treatment, intimidation or reprisal all persons involved in the investigation of disappearances.
وذُكّرت الدول بالتزاماتها بموجب الفقرة (3) من المادة 13من الإعلان بأن تكفل لجميع المشاركين في التحقيق في حالات الاختفاء الحماية من سوء المعاملة أو الترهيب أو الانتقام.

In addition, the Human Rights Council, in its resolution 12/2, condemns " all acts of intimidation or reprisal by non-State actors against individuals and groups who seek to cooperate or have cooperated with the United Nations, its representatives and mechanisms in the field of human rights " .

100. Paragraph 6 of draft article 12 set forth an obligation to ensure that " persons suspected of having committed an enforced disappearance are not in a position to influence the progress of the investigations, by means of pressure or acts of intimidation or reprisal directed towards persons involved in the investigation, witnesses, and the relatives of the disappeared person " .

Furthermore, the Special Rapporteur draws attention to two cases of reprisal that were reported in the media in November and December 2012, in accordance with Human Rights Council resolution 12/2, in which the Council called on representatives and mechanisms to continue to report on allegations of intimidation or reprisal.

Such encouragement is one of the greatest challenges encountered in the context of the investigation procedure because of the vulnerability of witnesses to intimidation or retaliation from the offenders and their consequent reluctance to report corruption.
