In addition to a finding by the Committee that the State party had breached its obligations under the Optional Protocol (see above, para. 49), the Committee found, with respect to article 6, that:

7. The Committee notes that the legislation of the State party contains provisions that make certain practices under the Optional Protocol punishable; however, it regrets that the State party has not fully implemented its obligations under the Optional Protocol.
7- تلاحظ اللجنة أن تشريعات الدولة الطرف تتضمن أحكاماً تعاقب على بعض الممارسات بموجب البروتوكول الاختياري؛ ولكنها تأسف لأن الدولة الطرف لم تنفذ تماماً التزاماتها بموجب البروتوكول الاختياري.

5.1 The Committee has noted the author's allegation that the State party violated its obligations under the Optional Protocol by executing her sons, in spite of the fact that a communication was sent to the Committee and a request for the interim measures had been issued on 22 February 2000.
5-1 أحاطت اللجنة علماً بادعاء صاحبة البلاغ أن الدولة الطرف قد انتهكت التزاماتها بموجب البروتوكول الاختياري عندما أعدمت ولديها على الرغم من الرسالة التي وُجهت إلى اللجنة وطلب اتخاذ تدابير الحماية المؤقتة الذي صدر في 22 شباط/فبراير 2000.

7. While welcoming the adoption of the Penal Code which entered into force in 2008 and the regulations of the General Tourism law, the Committee nonetheless regrets that the State party has not fully implemented its obligations under the Optional Protocol.

In case No. 1086/2002 (Weiss v. Austria), the Committee found that the State party had breached its obligations under the Optional Protocol by extraditing the author before allowing the Committee to address whether he would thereby suffer irreparable harm, as alleged.

142. In case No. 915/2000 (Ruzmetov v. Uzbekistan), the Committee noted the author's allegation that the State party violated its obligations under the Optional Protocol by executing her sons, despite the interim measures request issued by the Committee.
142- وفي البلاغ رقم 915/2000 (روزميتوف ضد أوزبكستان) أحاطت اللجنة علماً بادعاء صاحبة البلاغ أن الدولة الطرف انتهكت التزاماتها بموجب البروتوكول الاختياري عندما أعدمت ولديها على الرغم من طلب التدابير المؤقتة الذي قدمته اللجنة.

5.3 In its previous case law, the Committee had addressed the issue of a State party acting in breach of its obligations under the Optional Protocol by executing a person on whose behalf a communication was submitted to the Committee, not only from the perspective whether the Committee had explicitly requested interim measures of protection, but also on the basis of the irreversible nature of capital punishment.
5-3 وقد عالجت اللجنة في سوابقها القضائية مسألة الدولةٍ الطرف التي تتصرف تصرفاً ينتهك التزاماتها بموجب البروتوكول الاختياري بإعدام شخص يكون قد قُدّم إلى اللجنة بلاغ بالنيابة عنه، وذلك ليس فقط من منظور ما إذا كانت اللجنة قد طلبت صراحةً اتخاذ تدابير حماية مؤقتة وإنما أيضاً على أساس طابع عقوبة الإعدام الذي لا رجوع فيه.

76. This report presents some of the Egyptian efforts made to tackle the offences covered by the Optional Protocol. Although neither the Arab Republic of Egypt nor any of its children is involved in any armed conflict, it has made significant efforts on the basis of its obligations under the Optional Protocol, despite limited financial resources.
76- يقدم هذا التقرير بعض الجهود المصرية المبذولة للتصدي للجرائم التي يغطيها البروتوكول الاختياري، وعلى الرغم من أن جمهورية مصر العربية ليست منخرطة في أية نزاعات مسلحة ولا ينخرط أي من أطفالها في أي من هذه النزاعات، إلا أنها انطلاقاً من التزاماتها بموجب البروتوكول الاختياري قد بذلت جهوداً هامة على الرغم من محدودية الموارد المالية.
