As a general comment, it was observed that care should be taken that consistent terminology was used throughout the draft convention, particularly in respect of terms such as " place of delivery " , " time and location of delivery " , " place of receipt " , and the like.

Concern was expressed that if draft article 12, paragraph 3, operated to allow the parties to agree on a period of responsibility that began after the receipt of the goods for carriage or ended before delivery, there could be a corresponding gap in the right of control between the time of receipt and the start of the period of responsibility and between the end of the period of responsibility and the delivery of the goods.
وأُعرب عن شاغل مثاره أنه إذا ما كان إعمال الفقرة 3 من مشروع المادة 12 يجيز للطرفين أن يتّفقا على مدّة للمسؤولية تبدأ بعد تسلّم البضاعة لنقلها، أو تنتهي بعد تسليمها، فإنه يمكن حدوث انقطاع مقابل في حق السيطرة بين وقت التسلّم وبدء مدّة الالتزام، وبين نهاية مدّة الالتزام وتسليم البضائع.

(a) The place of receipt [or port of loading] is located in a State Party; or

197. It was observed that while draft paragraphs 11 (2) and 11 (4) both contained default rules for identifying the time and location of receipt and delivery, respectively, the second sentences of those paragraphs differed.

118. There was continued support in the Working Group for the inclusion of the place of receipt and the place of delivery as connecting factors upon which to base jurisdiction (see A/CN.9/572, para. 127).

48. Mr. Castello (United States of America) observed that the deeming rule for time of receipt of electronic transmissions was keyed to sending rather than receipt in order to permit the sender to know with certainty how the time period was calculated, but it was not intended to displace receipt.
