Article 2 of the Charter states that " no one shall be condemned to the death penalty, or executed " , and article 19 states that " no one may be removed, expelled or extradited to a State where there is a serious risk that he or she would be subjected to the death penalty, torture or other inhumane or degrading treatment or punishment " .

7- ويمكن تلخيص المقتضيات الرئيسية لأحكام المادة 16 من بروتوكول مكافحة تهريب المهاجرين كما يلي: تتخذ كل دولة طرف التدابير المناسبة لحماية المهاجرين المهربين من التعرض للموت أو العنف أو التعذيب أو غير ذلك من أشكال المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، وتوفير المساعدة المناسبة للأشخاص الذين يعرضهم المهربون للخطر، مع مراعاة الاحتياجات الخاصة للنساء والأطفال.

States parties should adopt appropriate measures, including legislation, if necessary, to protect smuggled migrants from violence, discrimination, torture or other cruel, inhuman and degrading treatment or punishment, as well as violation of their rights, and should provide smuggled migrants who have been victims of other crimes with effective access to justice and to legal assistance when it is envisaged in national legislation.
23- ينبغي أن تتخذ الدول الأطراف التدابير المناسبة، بما في ذلك التدابير التشريعية، عند الضرورة، لحماية المهاجرين المهرَّبين من العنف أو التمييز أو التعذيب أو غير ذلك من ضروب المعاملة أو العقوبة القاسية واللاإنسانية والمهينة، وكذا من انتهاك حقوقهم، وإتاحة سبل الوصول الفعلي إلى العدالة والمساعدة القانونية للمهاجرين المهرَّبين ممن هم ضحايا لجرائم أخرى عندما تسمح التشريعات الوطنية بذلك.

The European Commission's proposal of a Council Regulation " Concerning trade in certain equipment and products which could be used for capital punishment, torture or other cruel, inhuman or degrading treatment or punishment " was amended on 29 October 2004 (COM (2004) 731), and discussions in this regard are expected to be concluded in the near future.
